PORTABLE MINI GOLF RENTAL AGREEMENT & EVENT TERMS

Reservation status: A date is not secured until the required deposit is received, unless Golf Boro confirms otherwise in writing. Event-specific payment and cancellation terms shown on the invoice or quote are incorporated into this agreement.

1. Reservation & Payment. The Client agrees to pay the amounts and by the due dates shown above and/or on the Golf Boro invoice or quote. If a required payment is not received by its due date, Golf Boro may release the event date or pause performance until payment arrangements are confirmed.

2. Event Changes. Changes to the event date, time, venue, package, number of holes, add-ons, or setup requirements must be confirmed in writing. Changes are subject to availability and may result in additional charges, including travel, labor, rush, access, or customization fees.

3. Site Access & Setup Conditions. The Client will provide timely access to the setup area and a reasonably level, stable, safe surface with adequate space for the agreed course. The Client must disclose stairs, long carries, elevators, restricted loading zones, narrow access points, venue time limits, or other conditions that may affect delivery or setup. Golf Boro may adjust or decline a setup location that is unsafe or unsuitable for the equipment.

4. Outdoor Events & Weather. Golf Boro equipment may be used outdoors; however, outdoor mini golf is weather-dependent. The Client is responsible for having an appropriate indoor or covered backup location whenever possible.

   • Light Rain or Uncertain Forecasts. A forecast of rain alone does not automatically cancel an event. Golf Boro will make reasonable efforts to proceed when conditions are safe and the equipment can be properly set up and protected. 

   • Severe or Unsafe Weather. Golf Boro reserves the right to delay, modify, relocate, suspend, or cancel setup or play when weather or site conditions could create a safety concern or damage equipment. This may include lightning, thunderstorms, high winds, heavy rain, flooding, standing water, or other unsafe conditions.Client

   • Weather Cancellation. If the Client chooses to cancel an outdoor event because of weather, payments already made are non-refundable. When Golf Boro is notified before delivery or setup has begun, amounts paid may be applied as a credit toward one rescheduled event occurring within 13 months of the original event date, subject to availability.

   • After Delivery or Setup Begins. Once Golf Boro has departed for the event, delivered equipment, or begun setup, the rental is considered fulfilled for purposes of payment and no refund or rescheduling credit will be issued due to weather.

   • Golf Boro Weather Cancellation. If Golf Boro determines that conditions are unsafe and the event cannot reasonably be relocated, delayed, or completed, the Client may apply payments made toward another available date within 13 months. Golf Boro and the Client will work together whenever reasonably possible to relocate the course indoors, adjust the setup time, or otherwise allow the event to continue safely

   • Festival & Public Event Weather Policy. For festivals, fairs, community events, and other public events, Golf Boro will make reasonable efforts to operate as scheduled when weather and site conditions allow. If the event organizer cancels or postpones the event due to weather before Golf Boro has begun travel, delivery, or setup, payments made are non-refundable but may be applied as a credit toward one rescheduled event occurring within 13 months, subject to Golf Boro’s availability. Once Golf Boro has begun travel to the event, delivered equipment, or started setup, the reservation is considered fulfilled for payment purposes. No refund or rescheduling credit will be issued if the festival is later delayed, shortened, suspended, or canceled because of weather. Golf Boro reserves the right to delay, modify, suspend, or discontinue play when conditions are unsafe or could damage equipment, including lightning, high winds, heavy rain, flooding, or standing water.If possible, Golf Boro will work with the event organizer to adjust setup times, relocate the course to a covered or indoor area, or resume play if conditions improve.

5. Course Use & Supervision. The Client agrees to encourage safe, ordinary mini golf use. Guests should not sit, stand, jump, climb, lean heavily on, or move course pieces, obstacles, signage, or décor. Food and beverages should be kept off the playing surfaces. For events involving minors, the Client or event host is responsible for providing appropriate adult supervision at all times.

6. The Client acknowledges and accepts responsibility for ensuring that minors participating in the event follow all safety instructions and use the course and equipment appropriately. The Client is also responsible for the conduct of minors under the Client's supervision and for any damage to Golf Boro equipment, the course, or surrounding property caused by minors for whom the Client is legally responsible.

7. Damage, Loss & Excess Cleaning. Normal wear from ordinary mini golf play is expected. The Client is responsible for the reasonable cost to repair or replace Golf Boro property damaged, altered, moved, lost, or excessively soiled because of misuse, negligence, vandalism, intentional conduct, unauthorized handling, failure to follow safety instructions, or venue/guest actions during the rental period. This responsibility includes damage caused by the Client, the Client's guests, or minors for whom the Client is legally responsible. Golf Boro will document any charge and provide reasonable support for the amount requested.

8. Venue Approval, Permissions & Rules. The Client is responsible for obtaining venue approval and any permissions required for the event. The Client will provide Golf Boro with venue rules that affect loading, parking, access, flooring protection, setup, teardown, noise, décor, or operating hours. Golf Boro will make reasonable efforts to comply with rules disclosed before the event.

9. Assumption of Risk, Participant Safety & Release of Liability. The Client understands and acknowledges that participation in portable mini golf activities involves inherent and other risks. These may include, but are not limited to, injuries resulting from slips, trips, falls, contact with golf clubs, golf balls, course components or other equipment, uneven or slippery surfaces, weather-related conditions, environmental exposure, and other risks associated with participation in the activity. 

10. The Client voluntarily assumes the risks associated with participation in and use of the portable mini golf course and related equipment and agrees to encourage all participants to use reasonable care and follow event and safety instructions. 

11. To the fullest extent permitted by law, the Client releases, waives, discharges, and holds harmless Golf Boro, its owners, agents, employees, contractors, representatives, and affiliates from claims, demands, damages, losses, liabilities, or causes of action arising out of or related to participation in the portable mini golf activity or use of Golf Boro equipment, including claims arising from the ordinary negligence of Golf Boro or its representatives.

12. Golf Boro is not responsible for injury, property damage, delay, or loss caused by guest misconduct, misuse of equipment, failure to follow safety instructions, unsafe venue conditions outside Golf Boro's reasonable control, or use of the course in a manner inconsistent with ordinary mini golf play, except to the extent responsibility cannot legally be excluded.

13. Events Beyond Either Party's Control. Neither party will be considered in breach for a failure or delay caused by events outside that party's reasonable control, such as severe weather, natural disaster, government restriction, venue closure, utility interruption, transportation disruption, or similar emergency. The parties will make reasonable efforts to reduce the impact and, when appropriate, discuss rescheduling or other remedies consistent with the written cancellation policy.

14. Photography & Marketing. Golf Boro may photograph or video the mini golf setup, course design, signage, and décor for portfolio, website, and social media use. Golf Boro will make reasonable efforts not to feature identifiable guests as the primary subject without separate permission.

15. Entire Agreement & Electronic Signatures. This agreement, the applicable quote or invoice, and any written addendum together form the agreement between Golf Boro and the Client for this event. If an event-specific payment or cancellation term on the invoice or quote differs from this general agreement, the event-specific term controls that issue. Electronic signatures and electronically transmitted copies are intended to have the same effect as original handwritten signatures.​
